TCEQ Requires 70% Vegetative Cover Before Your Permit Can Close. Here's What That Means.

If you're waiting to file a Notice of Termination on a Texas construction project, the number that matters is seventy percent.

That's the threshold for final stabilization under the Texas Construction General Permit. Until your disturbed areas hit seventy percent uniform vegetative cover, the permit stays open, inspections keep running, and the liability stays with you.

Most contractors know this in general terms. Fewer know exactly what the inspector is measuring, when the clock starts, or what happens in the gap between "construction is done" and "the ground is covered." That gap is where projects sit for months longer than they need to.

Here's the practical version.

What is final stabilization under TCEQ?

Final stabilization means all soil disturbing activities are complete and the disturbed areas have been permanently stabilized — either with established vegetation providing at least seventy percent uniform cover, or with equivalent permanent structural measures like riprap, pavement, or gabions.

Seventy percent is measured against the density of native background vegetation for the area. It's not seventy percent of a golf course. It's seventy percent of what would naturally grow there.

For most Central Texas sites that means established Bermuda, native grass, or an approved seed mix covering the disturbed ground with visible root systems holding soil in place.

When does the 14-day rule apply?

Any time construction activity ceases in an area for fourteen or more calendar days, that area requires stabilization — even if the project isn't finished.

This is temporary stabilization, and it's the requirement most commonly missed. A section gets graded, crews move to the next phase, and that ground sits bare for three weeks. Under the permit, stabilization should have been initiated at day fourteen.

Temporary stabilization typically uses a fast-establishing cover crop rather than permanent turf. Annual rye in cool season, millet in warm season. It's designed to hold soil until construction resumes in that area.

How often are inspections required?

Every fourteen calendar days, and within twenty-four hours of any rainfall event of half an inch or more over a twenty-four hour period.

Both requirements run simultaneously. A wet spring can mean inspections several times a week. Each one produces a report, and each report that identifies a deficiency starts a correction clock — typically forty-eight hours to address.

Those reports are the documentation trail that supports your NOT filing. They're also the first thing an investigator asks for if a complaint comes in.

What happens between construction completion and permit closure?

This is where projects lose time.

The building is done. The utilities are in. The crews are gone. But the disturbed ground is bare, the permit is open, the inspections are still required, and nobody is thinking about the site because everyone moved to the next project.

Then someone realizes the permit never closed. Or a neighbor complains about muddy runoff. Or the owner asks why retainage hasn't been released.

The fix is straightforward — get seed in the ground, establish cover, document it, file the NOT. The problem is that establishment takes three to five weeks in warm season and considerably longer if you're seeding into fall or winter dormancy. Starting that process in November instead of September can cost you an entire season.

What are the penalties for stormwater violations in Texas?

Enforcement penalties under the Texas Water Code can reach twenty-five thousand dollars per day per violation.

In practice, most enforcement starts with a notice of violation and an opportunity to correct. But the exposure is real, and the escalation is fastest on sites with documented repeat deficiencies or unaddressed corrective actions.

The more common cost isn't a fine. It's the time spent managing a compliance problem, the inspection fees that keep accruing, and the retainage sitting unreleased on a project that should have closed months ago.

What's the difference between temporary and final stabilization?

Temporary stabilization holds soil during construction. Final stabilization closes the permit.

Temporary uses fast-germinating annual species that provide cover within days and die off or get graded away when work resumes. It's cheaper, faster, and its only job is preventing erosion in the interim.

Final stabilization uses the permanent species specified in your plans — usually Bermuda or an approved native mix in Central Texas. It has to establish, hold, and reach seventy percent cover before an inspector will sign off.

On a phased project you may spray the same ground twice. That's not waste, that's how the permit works.

Can I file the NOT before vegetation is established?

No. Final stabilization is a prerequisite for termination.

The Notice of Termination certifies that final stabilization has been achieved and all temporary controls have been removed. Filing it before that's true is a compliance problem of a different kind.

The practical approach is to plan backward from your target closure date. If you want the permit closed in October, seed needs to be in the ground by early September at the latest to allow for establishment.

Plan your stabilization before you need it

The single most common mistake we see is treating stabilization as an afterthought. Grading finishes, everyone moves on, and hydroseeding becomes a scramble months later when someone notices the permit is still open.
