Your Erosion Control Sub Should Be Fixing Problems Before You Know They Exist

If you're calling your erosion control sub to tell them a silt fence blew out, you've already got the wrong sub.
The entire point of hiring someone to manage your BMPs is that you stop having to think about them. The controls get installed correctly the first time, they get inspected and repaired on a schedule, sediment gets removed before it reaches capacity, and the site stays clean without a superintendent chasing anyone down.
That's the standard. Most subs don't meet it, and the cost of that gap shows up in ways that don't appear on any invoice.
What does a reactive erosion control sub actually cost you?
Start with the obvious. A corrective action notice from an inspector means someone on your team is now managing a compliance problem instead of building. That's superintendent hours, documentation, follow-up, and a paper trail that follows the project.
Then there's the repeat inspection. A failed inspection means another visit, another report, and another item on the punch list that shouldn't exist.
Then there's the real exposure. Stormwater violations in Texas carry penalties that escalate quickly, and the responsibility sits with the permit holder — not the sub who didn't show up. When an inspector documents an unmaintained control and it doesn't get corrected, that's on the general contractor.
And finally there's the schedule. A site that can't demonstrate compliance can't close its permit. A permit that can't close means a project that isn't finished, retainage that isn't released, and a bond that's still tied up.
None of that shows up as a line item. All of it costs money.
What should a good erosion control sub be doing without being asked?
Installing correctly the first time. Silt fence trenched to the proper depth, posts at correct spacing, fabric on the right side, ends turned uphill so water can't flank the run. Most failures trace back to installation shortcuts, not weather.
Showing up after rain events. Anything over half an inch means controls need to be checked. A good sub is on site within a day or two without a phone call.
Removing sediment before it becomes a violation. Accumulated sediment reduces capacity and eventually causes failure. It needs to come out before it reaches roughly a third of the barrier height, not after an inspector flags it.
Documenting the work. Photos of every repair, every replacement, every visit. When an inspector or an owner asks what's been done, that record should already exist.
Flagging problems early. If a control is in the wrong place for how water is actually moving on the site, the sub should say so. Plans get drawn before grading happens and reality doesn't always match.
How often should erosion controls be inspected?
Texas construction stormwater permits require inspections every fourteen calendar days and within twenty-four hours of any rainfall event of half an inch or more.
That's the regulatory minimum. On an active site with heavy equipment traffic, weekly is more realistic if you actually want controls to stay functional.
Whether your sub is doing those inspections or a third party is, someone needs to be responding to what the inspections find. Corrective actions typically need to be addressed within a defined window — often forty-eight hours. A sub who takes a week to respond to a flagged item is creating exposure.
What should I expect from a sub on a residential subdivision?
Different rhythm than heavy civil, same principles.
On production homebuilding you're running many active lots simultaneously, each with its own silt fence, inlet protection, and construction fence, all in various stages of a build cycle. The right sub is running a weekly route through the entire subdivision, hitting every active lot, repairing what needs repair, cleaning inlets, sweeping tracked material off the street, and documenting all of it.
You shouldn't be dispatching them lot by lot. They should know the schedule, know which lots are active, and be there.
What questions should I ask before hiring an erosion control sub?
How fast do you respond after a rain event? If the answer isn't within a day or two, keep looking.
Who does your inspections and what's your documentation process? You want photos, dates, and a record you can hand to an inspector.
What's your turnaround on a bid? A sub who takes a week to price a scope is going to take a week to respond to a field problem.
Are you carrying the right insurance and can you provide a COI today? If they have to go find their agent, that tells you something about how they run.
Do you handle final stabilization? Installation and maintenance are one thing. Getting the site to seventy percent vegetative cover so the permit can close is what actually finishes the job.
The sub who costs less usually costs more
There's always someone cheaper. There's usually a reason.
Silt fence that wasn't trenched properly fails in the first real rain. Controls that don't get maintained turn into corrective actions. A sub who doesn't answer the phone in August turns into a superintendent's problem in September.
The value of a good erosion control sub isn't in the install price. It's in never having to think about erosion control again for the duration of the project.
